WOODLANDS

You will be billed your Cabana Club Dues as part of the registration.  Swim team members no longer need to complete a Cabana Club Registration Form.  New member fee will be billed separately.  If you worked a maintenance day in 2023 and have not gotten back your maintenance fee, email [email protected] and you will be mailed a check.

If you are a 15-18 family who wishes to join Cabana Club, please pay your dues separately to Cabana Club. 

Families must work their required jobs and pay their Swim Team and Cabana Club dues in order to participate in Woodlands Swim Team, if your family does not work your jobs or if you do not pay your Swim Team Fees and Cabana Club dues, your family will not be able to participate in a swim meet.  Requirements are as follows: 

• JOBS - It takes teamwork to run a swim team and all families are required to work jobs.  The job requirements can be found here and a summary is below.  You must sign up for all your jobs prior to May 1, 2024. 
  • New Families: 6 jobs with 1 being a conference job (and Invitational Jobs - see below)
  • Returning Families: 8 jobs with 1 being a conference job (and Invitational Jobs - see below)
  • 15/18 Families: No jobs except invitational. 
• Everyone is eligible to do: 1 set up or take down, 1 transporting tents and no more than 2 social jobs.
• If jobs to run a meet are not filled, or we don't have enough parents to work conference we may adjust jobs to prioritize jobs to run a meet over social jobs (e.g., timer) or have 15-18 families work conference.   
• Chair positions must work a conference job.

• If you miss a job, your credit card will be charged a $100 fine per job. Your swimmer(s) will not be entered into a meet until the fine is paid.

• INVITATIONAL JOBS - 3 Invitational Jobs (July 13th and 14th) - Everyone must work at invitational including board members, 15& up parents, and chair positions. You must work 2 jobs and 1 set-up/take down Invitational Job. IMPORTANT: If you are away that weekend (July 13 & 14), please contact our Invitational Directors at [email protected]. You can pay a sub to work a snack shack shift, work a setup job and then you will be given another job toward invitational for a different time frame. 

 * Refunds are not offered for Kermits.  No refunds for Swim Team will be provided after May 1, 2024 and there is a processing fee of $100.  

For and in consideration of my swimmer’s/ swimmers’ participation in the Woodlands Cabana Club Swim Team Program and other value considerations, the undersigned parent or guardian consents to his/ her swimmer/s competing in or participating in all scheduled and unscheduled events, practice, or age group activities for or with the Woodlands Swim Team and releases the Woodlands Swim Team and the Woodlands Cabana Club, their members, officers, employees, and Board of Directors, from any liability or claim resulting from any accident or injury sustained by the swimmer/s during or coming to or from said events, and we further agree to indemnify and assure all expenses, costs, attorney fees and losses from said injury or accident to said swimmer/s and hold said Woodlands Swim Team and the Woodlands Cabana Club, their members, officers, employees, and the Board of Directors free and harmless therefrom.

INFORMED CONSENT AND WAIVER/RELEASE

In consideration of Woodlands Cabana Club and Woodlands Swim Team (defined as “WCC”) consent to the registering family (“Family”) and its members, child(ren) and guests to participate in WCC swim lessons, Woodlands Swim Team, and/or to generally use the WCC pool and facility, including any social activities (“WCC Programs”), the undersigned parent(s) or guardian(s) of the above-named Family, on behalf of themselves, their children/family members and guests, acknowledge and understand the nature of the activities and the associated risks of participation in the WCC Programs and use of WCC pools and facilities. I/we hereby release, hold harmless, and forever discharge WCC and its members, officers and employees from any and all injuries and damages to the Family, its members, child(ren) and guests and/or their property in connection with their participation in WCC Programs or use of the WCC pool, and facilities, or going to or coming from WCC.

The undersigned also agree to indemnify, defend, and hold harmless, WCC and its members, officers, and employees from all claims, expenses, costs, attorney’s fees and losses arising from or connected with any injury or damage to person or property so long as such injury or damage arises from or is connected with acts or omissions of the Family, any of its members, and/or child(ren) and guests in connection with their participation in WCC Programs and/or their use of the WCC pool and facilities, excepting only such loss, damage, cost, expense, or liability that is caused by the sole negligence or willful misconduct of WCC and/or its members, officers, or employees.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending WCC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at WCC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, WCC and WST employees, their officers, directors, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at WCC or participation in WCC or WST programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless WCC and WST, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of WCC and WST, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any WCC or WST program.

I agree that the photographers and the Woodlands Swim Team may publish portraits (video or still) of myself or my child(ren) for any lawful purpose associated with the team, including publicity, illustration, marketing, and web content. Images will typically contain more than two individuals; no names will be associated with the images, and no financial compensation will be provided. This release is valid for images initially published within one year of this consent, though the images may be reused after initial publishing.

Walnut Creek Swim Conference 2024 Participant Release of Liability (Please Read Before Signing)

In consideration of my child(ren) being allowed to participate in the Walnut Creek Swim Conference and the member team programs and related events and activities, I, the undersigned being the parent/guardian of the below named participant, or I am the participant 18 years or older, acknowledge, and agree that:

1. Voluntarily Agree to Participate. The participant is in good physical condition, physically fit, has been sufficiently trained for participation in Swim Team Related Activities. I voluntarily give permission for him/her to participate in Swim Team Related Activities. Swim Team Related Activities includes events of the Walnut Creek Swim Conference and the member team program, including but not limited to, swim practices, swim meets, swim team social events, and any other events described on the member team events calendar.

2. Assumption Of Risk. I am aware of the inherent risks of injury, death, and property damage involved in participating in Swim Team Related Activities and aquatic events involved in this program, including without limitation risks due to (1) lack of swimming ability; (2) the participant’s pre existing physical health condition; (3) weather; (4) water and pool conditions (including temperature, currents, waves and pollution); (5) collisions with other participants; (6) impacts with hard surfaces; (7) negligent supervision; and (8) slips and falls. These inherent risks may be the result of competition or practice.The pool deck, bottoms, sides, diving boards and starting blocks cannot be guaranteed to be smooth or free of defects, and there is a risk of injury as a result of tripping or striking an object. There are unpredictable dangers involved in this activity.If I observe an unusual or significant hazard, I will bring it to the attention of the nearest official and will remove the participant from participation, if necessary, to avoid any risk of injury to the participant and possibly to other participants.I am aware of the risks of injury, death and property damage that may result from, among other causes, the active or passive negligence of the Walnut Creek Swim Conference and member team program, which includes each of their officers, directors, employees, agents, contractors, coaches, lifeguards, parent volunteers, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of the premises used to conduct Swim Team Related Activities (collectively, “Released Parties”), including without limitation the risk of negligent instruction or supervision.I am voluntarily authorizing my child(ren), or agreeing if I am 18 years or older, to participate in all Swim Team Related Activities with knowledge of the risks of injury, death, property damage, and other risks, and assume any and all known and unknown risks of injury, death and property damage that may result from Swim Team Related Activities.

3. Release Of Liability. I release Released Parties from all liability to me, my child, my guests, my dependents and the participant for all liability, claims, damage, demand for personal injury, death or property damage, arising from or related to this agreement or to Swim Team Related Activities, whether the injury, death, or property damage occurs on or off the member team’s premises or the premises of any other member team of the Walnut Creek Swim Conference. This Release includes without limitation, any personal injury, death or property damage caused by the active or passive negligence of any of the Released Parties. I bear the sole responsibility for any loss. This release does not apply to any willful or intentional misconduct or serious or reckless disregard of another’s safety.

4 . Medical Release. In the event of an emergency, I authorize the Walnut Creek Swim Conference or member team program to secure from any licensed hospital, physician, and/or medical personnel any treatment deemed necessary for the participant’s immediate care and agree that I will be financially responsible for payment of medical services rendered.

5. Indemnification. I agree to indemnify and hold harmless the Walnut Creek Swim Conference, the member team program and the Released Parties from all liability for personal injury, including injuries resulting in death to me, my child(ren) and/or other family members, or damage to my property, the property to my child(ren) and/or other family members, or both, while I (or my child(ren) or family members) participate in Swim Team Related Activities. I further agree to indemnify and hold harmless the Walnut Creek Swim Conference, the member team program and the Released Parties against any claims or rights of action for damages which my participant child, or non-participant child, may have before or after she reaches the age of majority.

6. Knowing and Voluntary Execution. I acknowledge that I have carefully read this agreement, understand its contents, and understand that this agreement includes an assumption of risk of the Released Parties’ active or passive negligence and a release of their liability. I acknowledge that the Walnut Creek Swim Conference and the member team program are materially relying on this waiver to allow the participant to engage in Swim Team Related Activities. This release is binding upon me, my child, my guests, the participant, my heirs, dependents and assigns.

I HAVE FULLY READ THIS RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS. I FURTHER UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS RELEASE AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.FOR PARENTS/GUARDIANS OF PARTICIPANTS OF MINORITY AGE (Under age 18 at time of registration) List child(s) name(s):

This is to certify that I, as parent/guardian with legal responsibility for this participant, consent and agree to his/her release, as provided above, of all Released Parties, and, for myself, my heirs, guests and dependents. I release and agree to indemnify and hold harmless the Released Parties from any and all liabilities incident to my minor child's involvement or participation in Swim Team Related Activities as provided above, EVEN IF arising from the negligence of the Released Parties, to the fullest extent permitted by law. 

WALNUT CREEK SWIM CONFERENCE - COVID-19 RELEASE AND WAIVER

On behalf of myself and/or my son, daughter, or person for whom I serve as legal guardian (the “Participant”), I acknowledge with my signature that the Participant wishes to participate in a Walnut Creek Swim Conference activity or program (“activities or programs”) understanding that by participating in these activities and programs there is an inherent risk of potential exposure to infectious diseases, including but not limited to COVID-19/Coronavirus.

In consideration of having the opportunity to participate, and in acknowledging that I am aware of and willing to assume the risks associated with this activity, I hereby voluntarily agree to waive, hold harmless and indemnify the Walnut Creek Swim Conference and its Board, volunteers and employees from any and all claims, demands, damages and causes of action of any nature whatsoever arising out of ordinary negligence which I, my heirs, my assigns or successors may have against them for, on account of, or by reason of my participation in the above activities. I indicate my agreement to this hold harmless elective with my signature below.
